These terms and conditions apply to any communication and work between yourself, as a client or potential client, and Talonted Tales Editing/Xendara Haas.

Even after communication, you do not have to offer me your project. In turn, I do not have to accept any work offered.

All services are discussed and agreed upon by way of contract before the project begins. I will fulfill these obligations as stated. If the client wishes to change or add on services after the contract has been signed, new discussions will occur.

I, Xendara Haas, am the owner and operator of Talonted Tales Editing. I am responsible for my own income tax. The client or client company is not responsible for these.

I will personally conduct all services agreed upon. I do not subcontract work.

It is the client's responsibility to inform me of any language/themes that promote any sort of discrimination, hateful rhetoric, or abuse. If this type of content is not disclosed beforehand, I reserve the right to discontinue work on the project. Payment of work completed up to that point is still required.
The services and extent of the project will be agreed upon in writing before any work is done. This will include type of edit, number of rounds, starting date, completion date, etc. This will all be laid out in the contract both parties must sign before the project begins.

The cost of this service will be in the contract and cannot be changed without both parties consenting through a new contract or amendment.

There is a deposit of 25% of the total project cost to reserve time on my schedule for the project. An invoice will be sent. Fifteen percent of the downpayment is nonrefundable.

Another 25% of the total project cost is required upon start of the project. An invoice will be sent. If one pass has been agreed to, the last 50% of the total project cost is required upon completion of the project. If two passes have been agreed to, the third installment of 25% is due upon the completion of the first pass, and the last 25% is due upon completion of the final pass. The finished work will not be released until this payment is received. An invoice will be sent.

This payment structure is the default. However, other arrangements of payment can be agreed to if both client and Talonted Tales Editing consent. The payment schedule will be within the agreement/contract and signed by both parties.

This is the standard payment schedule. There will be no changes once the contract is signed. If a more flexible payment schedule is required, this must be discussed prior to signing the contract, and any agreed schedule will be stated within the contract.

If the client wishes to cancel the project prior to work starting and within 14 days of signing the agreement, the deposit will be refunded. If the client cancels the project after 14 days but before the project has been started, 10% of the downpayment will be refunded. Fifteen percent of the downpayment is nonrefundable after the initial 14 days. No other fees will be charged.

If the client wishes to cancel the project after work has started, they will be charged for the work completed up to that point.

If I cannot complete the project per the agreed upon contract due to unexpected circumstances (such as health issues or family emergencies), I will contact the client as soon as possible in writing and by phone (if possible) to either renegotiate the deadline or discuss solutions. The client may decline a renegotiation of the contract. If prior to work starting, the deposit will be returned. If after, payment of work completed is required, but there will be no additional costs.

Plagiarism is the responsibility of the client to avoid. However, if I identify plagiarism, I hold the right to immediately stop work on the project. If it appears to be a mistake, discussion will take place to move forward. If I believe plagiarism was intentional, I will discontinue the project and bill for work completed. It is not my responsibility to review for plagiarism, and the client will not hold me responsible for any charges of plagiarism within the work. Please be aware, if the client uses AI in any capacity to generate content of their manuscript, plagiarism is possible.

Both parties, the client and myself, have the right to cancel the project due to a breach of contract.

Once the editing project is completed and all documents are returned to the client, any additional changes made are the responsibility of the client.

The client should be aware neither human nor software can guarantee an error-free manuscript. Both parties, the client and myself, are responsible for editing to the best of our abilities. Partaking in writing groups, having alpha and beta readers, and hiring a separate proofreader are highly encouraged to reduce errors.

The use of an editor cannot guarantee your manuscript being accepted by an agent or publisher.

My editing feedback and commentary cannot be used as promotional material for the manuscript, and I do not offer official reviews.
